Mwenda Mbijiwe’s mother emotionally knelt before the court, tearfully calling on God to remember her suffering as she continues her agonizing search for her son, who has been missing for years.

She later took the stand to explain the terrible ordeal she has gone through in the hands of the Directorate of Criminal Investigations in search for answers about the whereabouts of her son.

The mother who has always maintained that her son was abducted by state agents along Thika Superhighway told court that after the disappearance of her son, she attempted seeking help from Timau Police station in Buuri West-Sub County but all her efforts went unanswered.

She presented a letter which she say was written in 2025 by the Office of the Director of Public Prosecutions (ODPP) to the Directorate of Criminal Investigations (DCI), asking whether the DCI had any objections to releasing Mwenda on bond.

The letter which the family as a key piece of evidence was handed to the court during proceedings in the habeas corpus application seeking answers about Mwenda’s whereabouts. If the letter is admitted into evidence, the defence says it could strengthen the application by suggesting Mwenda was, at one time, in police custody.

Lawyer Ondieki for the family argued the communication raises serious questions about the official record and the DCI’s handling of the matter. He told the court the letter shows the ODPP had engaged with the DCI about Mwenda’s potential release, a fact they say is inconsistent with the authorities’ public position that his whereabouts remain unknown.

Prosecution and DCI representatives have yet to respond in court to the family’s claims about the letter. The court will first determine whether the document is authentic and admissible before any of its contents are weighed as evidence.

The habeas corpus hearing continues on February 11, 2026, with the family pressing for a thorough investigation and accountability. The emergence of the purported ODPP–DCI letter adds a fresh and potentially consequential development to a case that has drawn public attention and deepened calls for answers.
