Parties in Alleged Will Forgery Case Seek Mediation

The parties involved in a case concerning the alleged forgery of a codicil to the will of the late Balkrishna Ramji Devani have requested to withdraw the matter from court in order to pursue mediation.

The accused Dinta Devani Pathania, Abhay Singh Pathania, Samuel Ngugi, and Addah Nduta Ndambuki appeared before Magistrate Dolphina Alego at the Milimani Law Courts in Nairobi. During the session, the prosecution informed the court that the Office of the Director of Public Prosecutions (ODPP) had received a letter from the suspects requesting time to engage in mediation.

Advocate Danstan Omari, representing Dinta Devani Pathania and Abhay Singh Pathania, explained that Dinta is the complainant’s younger sister and Abhay Singh is her brother-in-law. He emphasized that the case stems from a family dispute following the death of their father and is also under consideration in a succession case before the High Court.

Omari told the court that the parties had sought an audience with the DPP to request mediation, as they believed the matter could be resolved amicably given its familial nature.

The complainant, Kalpa Chandarana, confirmed in court that she was open to mediation, citing her relationship with the first accused, who is her younger sister.

The court scheduled a mention of the case for July 2, 2025, to confirm the outcome of the mediation process.
