Court to Decide Whether Rex Masai Inquest Will Be Reopened or closed

Court concludes hearing after final witnesses testify, with IPOA stating suspect officer could not be identified due to insufficient evidence.

The inquest into the death of Rex Masai has been closed for determination after final testimony, with investigators telling the court the shooter could not be identified, leaving the ruling set for June 30, 2026.

The Milimani Magistrate’s Court will on July 30, 2026, rule on whether the inquest into the death of Rex Masai should be concluded or reopened to allow the National Police Service (NPS) to call seven additional witnesses.

The issue arose after the Independent Policing Oversight Authority (IPOA) formally closed its case following the testimony of its final witness, the investigating officer, who was cross-examined by all parties.

IPOA urged the court to close the proceedings and proceed to make its findings based on the evidence already presented. However, lawyers representing the National Police Service opposed the move and requested an opportunity to introduce seven more witnesses before the inquest is brought to a close.

The court directed parties to address the issue and set July 30 as the date for its ruling on whether the additional witnesses will be allowed to testify. The decision is expected to determine the next course of the proceedings, including whether the matter proceeds to final submissions and determination or whether fresh evidence will be admitted.

The inquest is examining the circumstances surrounding the death of Rex Masai, who died during the anti-government protests, a case that has attracted significant public attention.
