Three men have been sentenced to life imprisonment after a Nyeri court found them guilty of robbery with violence and gang rape in an incident that occurred in April 2023.
Samuel Kabutu Kiunuhe, Michael Ndungu Kiritu and Daniel Muraguri Wangari were convicted over the attack at Kiamwathi area in Nyeri County. The prosecution told the court that the three men acted together and were armed with a knife when they attacked the complainant. They robbed her of household belongings and subjected her to violence. Kiunuhe and Kiritu faced additional charges of gang rape, while Wangari was charged with the offence on the basis of common intention.
During the trial, the prosecution called seven witnesses. Evidence presented included identification evidence as well as DNA analysis by the Government Chemist. DNA results linked samples collected from the complainant to Kiritu and Kiunuhe. The court also determined that the evidence presented was sufficient to place Wangari among those involved in the attack.
Senior Resident Magistrate Mary Gituma, delivering the judgment at the Nyeri Chief Magistrate’s Court, ruled that the prosecution had proved its case beyond reasonable doubt and convicted all three men. The court imposed a life sentence for robbery with violence and a 20-year prison term for gang rape. The sentences will run concurrently.
The case was prosecuted by the Office of the Director of Public Prosecutions, with prosecution counsel Ms. Obat leading the State’s case.
