The Kahawa Law Courts have dismissed an application by the Directorate of Criminal Investigations (DCI) seeking to detain Manyatta MP Gitonga Mukunji and two others for 14 more days. The three were arrested over alleged incitement during the July 7th Saba Saba protests.
Appearing before Principal Magistrate Richard Kipkemoi Koech on July 24, 2025, the DCI argued it needed more time to complete investigations into suspected terror-related offences. However, the court declined the request, ruling that the accused should only present themselves to investigators when formally required; not weekly as had been proposed.
Magistrate Koech noted that the DCI had not provided sufficient grounds to justify extended detention. The Director of Public Prosecutions, James Mashira, assured the court that investigations were already 70 percent complete.
Outside the courtroom, MP Mukunji called for calm and urged the public to respect the judicial process as the matter proceeds. The case stems from his arrest on July 7th in connection with statements made during the Saba Saba protests, which drew national attention and led to several arrests.
He also disagreed with the need for national dialogue talks being proposed by Hon. Raila Odinga, terming them as not genuine. Magistrate Richard Kipkemoi Koech directed that the next mention of the case will take place on 26th August, 2025.
