A Kwale man has been sentenced to life imprisonment after a court found him guilty of defiling a seven-year-old boy whom he lured to his house with a promise of sweets.
Athumani Juma was convicted by the Msambweni Senior Principal Magistrate’s Court after the prosecution presented five witnesses whose evidence helped establish the circumstances surrounding the offence committed in June 2025.
The court heard that the incident occurred on June 7, 2025, at Vivalani Village in Lungalunga Sub-County, Kwale County, where Juma, a water vendor known to the child, allegedly used the promise of sweets to entice the boy into his house. Once inside, with no one else present, Juma sexually abused the child before threatening him against revealing what had happened.
The boy initially kept the ordeal to himself, confiding only in his brothers. However, the abuse later came to light after he developed a physical condition that raised concern among his relatives.
On June 14, 2025, a relative questioned the child about his condition, prompting him to disclose the abuse and identify Juma as the person responsible. The matter was subsequently reported to the police. Juma was arrested by members of the public and handed over to law enforcement officers, paving the way for investigations and his eventual prosecution.
During the trial, Juma denied the charge, claiming that he had been framed. The court, however, found his defence unconvincing after considering the evidence presented by the prosecution.
In its judgment, the court found the child’s testimony credible and consistent. The magistrate also considered the medical evidence, which corroborated the boy’s account, before concluding that the prosecution had proved the charge beyond reasonable doubt.
On October 5, 2026, Juma was convicted of defilement contrary to Section 8(1), as read with Section 8(2), of the Sexual Offences Act and sentenced to life imprisonment. Section 8(2) of the Act provides for life imprisonment where a person is convicted of defiling a child aged 11 years or younger.
The case highlights the serious criminal consequences of sexual offences against children and the importance of bringing such cases before the courts, where testimony and supporting evidence can be examined through the criminal justice process.
