Bungei told court that no gunfire took place on that night and to the best of his knowledge anyone could have shot at the protestors.

He said it is not only police officers who have access to firearms, adding that police personnel from various units only reacted to the demos but were never deployed so there is no duty roster.

“I cannot provide details there was none I say this because that was was a reaction response, Police deployment is daily and the police were reacting to the situation,We had the military team that was a multi agency respond,” Bungei said.

He told court that on that day he received a call from OCPD Central that an attendant from Bliss hospital had made a report that someone had succumbed to injuries at their facility.

“It was demonstration that caused loss of property which necessitated the police to enter in town and control the situation,” Bungei said.

Further adding that It was a reactional situation and police had to act to save property and lives

Bungei said he did not know if Rex sustained any injuries and, if he did, he could not confirm whether the injuries resulted from a gunshot.

“I’m not aware that the excessive bleeding was due to the wound by a bullet,” court heard

The inquest aims to uncover the truth behind Rex Masai’s death.
