It was alleged that Kimemia,Jane Nyambura Karia, and Daniel Munyao Mbithi conspired to defraud Esther Wanjiru Mwakuwa and Daniel Abednego of Sh 9,460,000.

The court heard that the fraud involved a forged lease for Land Reference Number Nairobi Block 83/1308, measuring 0.0225 hectares in Umoja Inner Core Estate.

The disputed land, valued at Ksh 15 million, had been sold to the complainants.

The three appeared before Magistrate Ben Mark Ekhubi and denied the charges of obtaining money by false pretenses and uttering false documents.

According to the police, the three allegedly orchestrated the scheme on December 17 at the Central Land Registry in Nairobi. They are accused of presenting forged documents to facilitate the fraudulent transfer of ownership.

In a separate count, Daniel Munyao Mbithi faced additional charges of obtaining Sh 1.9 million from Daniel Abednego by falsely claiming he could sell him the same piece of land. Mbithi is also accused of presenting a fake lease title to officers from the Directorate of Criminal Investigations (DCI), purporting it to be a genuine certificate of lease.

Mbithi was released on a cash bail of Sh 2 million, while Anthony Kimemia Gathumbi and Jane Nyambura Karia were each released on Sh 850,000 cash bail.

The case will proceed on February 26, 2025.
