Court Adjourns Eric Omondi’s Obstruction Case After State Says Witnesses Were Unavailable

Court Allows Prosecution to Adjourn Eric Omondi Obstruction Case

Comedian Eric Omondi’s case over alleged obstruction of motorists has been adjourned to November 11 after the prosecution said some witnesses were unavailable.

The prosecution has been allowed to adjourn the case in which comedian Eric Omondi is charged with obstructing motorists, after the State told the court that some of its witnesses were unavailable.

The matter had come up for hearing when the prosecution made an application for an adjournment, arguing that the availability of witnesses was sometimes beyond its control.

The State told the court that it had not previously sought an adjournment in the case and urged the court to allow the request in the interest of ensuring a fair trial.

However, the application was opposed by Omondi’s defence counsel, Danstan Omari, who raised concerns over what he described as delays by the prosecution in presenting its witnesses.

The defence argued that the prosecution had previously indicated that the witness would be available within a short period, but had nevertheless returned to court seeking an adjournment despite allegedly having made contact with the witness.

Omari urged the court to consider the circumstances surrounding the delay and questioned the prosecution’s handling of the case. The court considered submissions from both sides before allowing the State’s application.

In granting the adjournment, the court acknowledged the objections raised by the defence but said it would give the prosecution the benefit of the doubt in the circumstances.

The court subsequently directed that summons be issued to the witnesses to ensure their attendance when the case resumes. The matter was then fixed for further hearing on November 11 at 11am.

Omondi is facing charges arising from an incident in which he is accused of obstructing motorists, with the case now set to proceed once the prosecution’s witnesses are availed before the court.

The Eric Omondi has a history of taking part in public demonstrations and activism.
