A Nairobi court has declined to review bail for Sammy Murigi Maina, a matatu driver accused of causing a crash that killed three passengers and injured others along Enterprise Road in June 2026.
Milimani Magistrate Paul Mutai ruled that Maina will remain in custody until key prosecution witnesses testify, saying he was not persuaded to review the bail decision at this stage.
The court expressed concern over the slow progress of the trial, noting that only one prosecution witness had appeared to testify during Wednesday’s hearing.
Magistrate Mutai directed the prosecution to prioritise the presentation of eyewitnesses to ensure the case proceeds without further delays. The prosecution was also directed to investigate allegations that the investigating officer was frustrating the progress of the hearings.
The victims had raised concerns over the officer’s conduct, alleging that the investigator was sabotaging the case and calling for the officer to appear in court to clarify the claims.
Maina’s defence had applied for a review of the bail decision, arguing that the accused was suffering while in custody. However, the court declined to grant the request, maintaining that he would remain detained at this stage of the proceedings. Maina was arrested nearly two months after the June 3, 2026 crash and subsequently arraigned in court to face multiple traffic-related charges.
He is charged with three counts of causing death by dangerous driving, contrary to Section 46 of the Traffic Act, Cap 403 of the Laws of Kenya.
The case will be mentioned on November 9, 2026, when the prosecution is expected to proceed with its witnesses.
