Former Nairobi Provincial Commissioner Davis Nathan Chelogoi has been sentenced to three years in prison over a Sh1.3 billion land fraud case involving a 7.39-hectare parcel of land in Lower Kabete, Nairobi.
Chelogoi was convicted on five counts he faced in the case, which involved fraudulent dealings in the prime piece of land valued at approximately Sh1.3 billion.
Milimani Chief Magistrate Dolphina Alego handed down the sentence on Monday, November 2, 2026, directing that all the three-year sentences run concurrently. The charges against Chelogoi included conspiracy to defraud, forcible detainer, two counts of forgery and uttering a forged document. The prosecution alleged that he conspired to deprive businessmen Ashok Rupshi Shah and Hitenkumar Amritlal Raja of the disputed property, identified as Nairobi/Block/80/44.
The court found that Chelogoi forged a letter of allotment dated January 31, 1995, which purported to have been issued by the Commissioner of Lands. He was also convicted of knowingly presenting forged documents at the Directorate of Criminal Investigations (DCI) headquarters along Kiambu Road on October 11, 2023. The documents included the disputed allotment letter and a certificate bearing a forged signature and stamp attributed to a land registrar, Paul Achieng Pesa.
The prosecution, led by Sonia Njoki, Hillary Isiaho and James Murage, called 19 witnesses and presented documentary and expert evidence to support the charges. The prosecution had accused the former administrator, who served as Nairobi Provincial Commissioner during the Moi era, of participating in the fraudulent acquisition and registration of the disputed property.
Chelogoi had maintained that former President Daniel arap Moi allocated him the land in 1995, but the court found that he had failed to provide sufficient authenticated documents to support his ownership claim.
