Court proceedings established that the offence occurred on January 22, 2026, at approximately 11pm in the Bulla Ijara area of Garissa Township. In its judgment, the court relied on the testimony of the child, identified as P.M., alongside evidence presented by four other prosecution witnesses. The child’s identification of the accused as her father was also considered.

Medical evidence, including a P3 form and treatment records, further supported the prosecution’s case. The court observed that the accused had a responsibility to safeguard the child because of their parent-child relationship, but instead abused the trust placed in him.

The magistrate noted that the victim’s age was a key consideration in determining the sentence under Section 8(2) of the Sexual Offences Act, which provides for life imprisonment where the victim is aged 11 years or younger.

The accused was consequently sentenced to life imprisonment and has 14 days to file an appeal against the conviction or sentence.
