Patient Threatens to Sue AAR for Hiring ‘Unlicensed’ Doctor After SHA Rejected Surgery Claim

A Nairobi patient has threatened to sue AAR Hospital, Muthaiga, accusing the facility of hiring an unlicensed doctor who performed surgery on her, leading to the rejection of her medical cover under the Social Health Authority (SHA).

In a demand letter dated January 14, 2026, Lawyer Danstan Omari has written to the Chief Executive Officer of AAR Hospital on behalf of Lydia Mokeira Minyega, to pursue the matter.

The advocates state that Lydia was admitted at AAR Hospital on January 6, 2026 for surgical treatment of a broken arm and was due for discharge on January 9, 2026.

However, the law firm says a pre-authorization request for part payment of her hospital bill under SHA was declined after the insurer allegedly established that the doctor who performed the surgery did not hold a valid practising licence for the year 2026 at the time of the procedure.

According to the message from SHA, the pre-authorization request for surgical services at AAR Hospital Limited Muthaiga failed because practitioner Dr J.W (code 808980) had an invalid licence as at January 9, 2026 at 1.17pm.

“Pre-authorization request for Surgical services at AAR HOSPITAL LIMITED MUTHAIGA for LYDIA (Client ID CR6419852083232-0) has failed due to practitioner Dr J.W (code 808980) has an invalid license as at 9 Jan 26 1.17PM,” the message reads, adding that for help, the client should contact SHA on 147.

Omari has now demanded that AAR Hospital admits liability within 24 hours of receiving the demand letter, blaming the hospital for negligence and insisting it bears full responsibility for the fallout.

He warned that failure to heed the demand would result in legal proceedings being filed against the hospital without any further notice.
